Terms of Service

By accessing and using the Kyndred application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you are prohibited from using or accessing this app.

The Kyndred application is intended for users who are at least 13 years of age. By using this app, you confirm that you are at least 13 years old. If you are under 18 years of age, you should use this app only with the involvement and supervision of a parent or guardian. We reserve the right to restrict certain content or features for users under 18 years old.

We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our servers immediately.

To use certain features of the application, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

We reserve the right to normalize, format, or edit information provided during registration (such as capitalizing names) to ensure consistency across our platform. By registering, you grant us permission to format your profile information in accordance with our platform standards.

You agree not to use the application to:

• Violate any applicable law or regulation
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Harass, abuse, or harm another person
• Collect or store personal data about other users without their permission
• Upload or transmit viruses or other harmful code

Your use of the application is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

The Kyndred application and its original content, features, and functionality are owned by Kyndred and are protected by copyright, trademark, and other intellectual property laws.

By submitting, posting, or displaying content on or through the application, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the application.

We may terminate or suspend your account and access to the application immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

You may request account deletion through the app settings. Upon deletion request:

• You will have a 30-day grace period during which you can cancel the deletion by logging back in
• After 30 days, your personal information (email, last name, bio, profile picture) will be permanently removed
• Your family contributions (posts, photos, comments) will remain as part of the family archive, attributed only to your first name (e.g., "Sarah" instead of "Sarah Smith")
• If you return to Kyndred in the future, family guardians can help reconnect your content to your new account

In no event shall Kyndred, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the application
• Any conduct or content of any third party on the application
• Any content obtained from the application
• Unauthorized access, use, or alteration of your transmissions or content

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our application after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the application.

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
